This Policy covers all business under the Genco Energy Group. (Genco)
This collectively includes all Genco entities registered in Australia, New Zealand and Indonesia including all business conducted by them worldwide.
This serves as a guide to the intent and spirit with which Genco approaches and conducts its business internationally. This includes our relationship with any customer, supplier, contractor, alliance partner, regulatory authority or project funder.
In simple terms this is what you can expect from Genco. Notwithstanding, each specific project / relationship is conducted under its own full and formal NDCA / Confidentiality Agreement.
1. Genco remains committed to the privacy and confidentiality of everyone who does business with us.
2. Any information collected from discussions and communications in the normal course of business will be treated by Genco as private and confidential. All information will be managed and secured to at least the same degree of care and security that Genco manages its own information, and that we would expect anyone else to manage the same.
3. Information includes anything relating to our business in either verbal, hard copy and electronic format.
4. Information can include (but is not limited to): NDCA agreements, general correspondence, requests for information, technical specifications, technical drawings, trade secrets, technical know-how, financial costings and forecasting, sales and marketing, purchase orders, procurement, logistics, trade and alliance agreements, test/quality/safety/compliance records and project finance.
5. Genco will not use any information for any purpose other than for the purpose that it was originally provided and intended.
6. Genco will not disclose any information unless by prior mutual agreement with the counterparty concerned. The only exception is a disclosure required by law.
7. Genco will not make any PR or media release unless by prior mutual agreement with the counterparty concerned.
8. Genco will maintain a continuing obligation to confidentiality and security, with either a specific project that is completed, or with discussions and negotiations for a project that does not proceed.
9. Genco will either return or destroy any information at the direction of the counterparty that provided it.
